Study Permit Refused
There are two ways for a foreign national to respond to Immigration, Refugees and Citizenship Canada's (IRCC) denial of a study permit:
File an appeal of the decision: Foreign nationals have the right to appeal and request a review if they feel that their application satisfies all IRCC requirements but the study visa was denied unfairly or wrongly.
Send in a fresh application: The applicant's only option is to reapply if they suspect that the reasons for rejection are legitimate. It is important that they carefully address the prior grounds for rejection in the new application. Additionally, the candidate must be sure to collect any updated documents that are required, such as updated bank statements or the start date on the acceptance letter.
If your application is rejected, what should you do?
In the event that a study permit application is denied, the visa officer will notify the rejected applicant in writing. In this letter, the immigration officer will specify the reason or reasons for rejection from a predetermined list. Basic details about the reasons for the refusal are provided in this list of reasons for refuse.
Nonetheless, the applicant is entitled to obtain the notes from the visa officer substantiating the denial of their application. To help the applicant understand how to respond to the rejection, it is highly advised that these notes be sought. After obtaining the case notes from the visa officer, the applicant can evaluate the validity of the reasons for the rejection. The best course of action is to submit a fresh application after making sure that the mistakes are fixed if the study permit was denied for legitimate grounds, such as the applicant's failure to provide any crucial papers.
The applicant may file an appeal seeking reconsideration if the study permit was denied for reasons they feel to be unjustified. Time may be a significant factor in both the appeals and resubmissions processes. Therefore, in the event that the applicant is unable to secure a study permit in time to commence the program on the originally scheduled date, they should be ready to call their institution and request changes to their start date.
